Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

Limitation on Liability Provision of any Software under this Agreement is experimental and shall not create any obligation for LoudStand to continue to develop, productize, support, repair, offer for sale or in any other way continue to provide or develop Software either to Licensee or to any other party. THE SOFTWARE IS PROVIDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. Termination

Data protection and the private sphere of the users are very important to LoudStand. The gathering and use of your personal data which takes place exclusively within the framework of the statutory provisions of applicable data protection laws. By means of this data privacy policy, LoudStand is providing information concerning the processing of personal data on the LoudStand website and in the mobile application(hereinafter referred to jointly as “App”).

Area of Applicability

This data privacy policy applies to LoudStand App with all content, functions and services, within the operating systems which are offered (iOS, Android).

 

Processing of Personal Data

Personal data is information relating to factual or personal relationships of a defined or definable natural person. Above all, this includes information which allows your identity to be traced, for example name, address or email address.

Statistical data which we collect during a visit to our App for example and which cannot be connected to you does not come under the definition of personal data. Rather this is so-called anonymous data.

 

Processing when using the apps with registration

In order to use the App, you will be asked to sign up using an email address and choosing a password. Alternatively, you can choose to use sign up using one of the Social Media Login. The aforementioned process takes place solely on a voluntary basis.

The LoudStand App therefore provide personalisation functions in order to:

● keep the settings concerning favourite team up to date between different devices;

● provide the app with a profile picture, name, age and location

Via incorporated social media services, this personalisation can be carried out by the user in the apps. For this purpose, LoudStand uses the systems “Facebook Sign In” (a service of Facebook Inc, 1601 Willow Road, Menlo Park, California, 94025, USA), “Google+ Sign In” (a service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) and “Twitter Sign In” (a service of Twitter Inc, 1355 Market St #900, San Francisco, CA 94103, USA,). In cases where personal data is transferred to the USA, the named providers have undertaken to comply with the EU-US Privacy Shield. A connection between the App and the Facebook or Google account takes place. From Facebook, we save and process the email address, the URL of the profile picture, the name, the public profile and the token. From Google, we save and process the standard entitlements set by Google. These are the profile, JWT (token) and Google ID. These extended personalisation functions are optional and you can remove the personalisation and connection with the social media services in the app at any time, but it may affect your experience in the App. The purpose and scope of the data collecting and the subsequent processing and use of the data by the social media providers, as well as your rights and settings options in this respect concerning the protection of your private sphere can be found in the data protection notices of  Facebook, Google.

The legal basis is Article 6 Paragraph 1 f) GDPR, based on the legitimate interest of LoudStand in providing extended functions for a more personal use experience. This is also the legal basis for the general processing when using the App with registration, based on the legitimate interest in creating synchronisation options between end devices and providing functions with social interaction options. Should you not wish to use the registration, the described functions cannot be used.

 

Disclosure of Personal Data

In principle LoudStand does not pass your personal data on to third parties. The data collected by us is only passed on to third parties, if this is necessary to provide the technical functionality of the App or another legal basis for the disclosure of data exists. Personal data may only be used by our service providers in order to fulfil their tasks. These were carefully selected by us and engaged in writing. They are subject to our instructions and are regularly monitored by us. Other use of the information is not permitted and is not carried out by any of the service providers used by us.

Alongside the service providers listed separately in this data privacy policy, data may be disclosed to individual categories of recipients, i.e. to companies in order to support promotions and special campaigns, as well as to external advisors and enforcement authorities.

 

Permissions

For certain functions, the App needs to be able to access certain services and data on your device. Depending on which mobile operating system you use, this may require you express agreement to the accessing. Below, we will explain to you – in separate terms according to the mobile operating systems for which we offer the app – what authorisations the apps requests and what these are necessary for.

a) iOS

Mobile data: This function enables the apps to download and update data outside of a WLAN network via mobile data connections (for example GSM, UMTS or LTE).

Location: This function enables the app to save your location in order to help other football fans to connect with you based on your hometown. You can also find other fans from your area by looking at their user profile.

Phone Number Verification: This function enables the app to save make sure your votes and interaction on any of the screens belong to you and you only. To ensure credibility and transparency of our user generated statistics in the app we link one phone number to each profile to minimize creation of fake profiles and fake voting.

b) Android

Apart from the standard entitlements for the operation of Android apps (such as the receipt of internet access or the option of letting the device vibrate; also called “normal entitlements” by Google), we do not request any further entitlements than the ones mentioned for iOS.

 

Analysis

In order to improve our App, we use various technologies to analyse the usage behaviour and to evaluate the associated data. These procedures take place anonymously or on the basis of pseudonyms, however never in a directly personal way. Below, we wish to explain these technologies and the providers used for this purpose in more detail.

For this purpose, we use so-called number pixels with which we create statistics, which show for example how often the App was started, and which areas of our App are the most popular. In addition, the analysis allows us to make the App more stable, for example, by means of the transfer of crash logs to us.

The legal basis is Article 6 Paragraph 1 Letter f) GDPR, based on our legitimate interest in analysing usage behaviour in order to improve and further develop the App.

For the apps on iOS and Android we use the services of Google Analytics for Firebase (a service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). In cases where personal data is transferred to the USA Google LLC has undertaken to comply with the EU-US Privacy Shield.

You can deactivate these services, if you no longer require the Loudstand analyses. For this purpose, you can easily carry out the deactivations with our assistance by writing to us at info@loudstand.com.

 

Your Rights

Should you so request, we will notify you whether and what data relating to you is saved by us. If the statutory requirements are in place, you also have the right to correction, restriction of the processing or deletion of the data. You also have the right to receive the data relating to you in a structured, up-to-date and machine-readable format from us. In order to claim these rights, please get in touch via the contact information above. This also applies, if you wish to object to the processing of your data in accordance with this data privacy policy in full or in relation to individual measures.

Finally, you have the right to complain to the competent supervisory authority for data protection, if you believe that the processing of personal data relating to you breaches data protection laws. You can claim this right by contacting a supervisory authority in the member state of your place of residence, place of employment or the location of the alleged breach.
